Introduction – Queensland

Among its states, Queensland stands out, a jewel in the crown that perfectly encapsulates the Australian dream. From its iconic natural wonders to its thriving urban centres, Queensland offers a unique blend of experiences and opportunities. As immigration policies and procedures evolve, understanding the nuances of moving to this spectacular state becomes crucial. If eligible, you can apply for a Queensland subclass 190 State Sponsored Visa (onshore/offshore applications welcomed) or a subclass 491 Regional State Sponsored Visa.

Key Dates and Guidelines: Queensland’s 2023-24 Visa Program and EOI Submission Details

The Exciting news is that Migration Queensland has opened its state nominated visa program for the 2023 – 24 program year on 5 September 2023.

It is important to note that the 2023/24 program will only consider EOIs lodged on or after 5 September 2023.

For applicants who have previously lodged an Expression of Interest during the 2021/22 migration program and who:

(a) received an invitation, and

(b) paid their application fee and

(c) provided all documents to Queensland Migration by 5pm June 30, 2023, and

(d) have not received a final decision, Queensland Migration will continue to assess your application. However, for all other applications that have not met the above criteria, a new Expression of Interest (EOI) will need to be submitted. 

Updated Visa Requirements and Competitive Application Process for 2023-24

Queensland Migration have relaxed some requirements for this migration year. Namely, the minimum points needed for the Queensland 190 state Sponsored Visa / 491 Regional State Sponsored visa, level of English and the work experience requirements are more relaxed than last year.

The process for applicants to be nominated by Queensland Migration is currently very competitive. For this reason, it is important to gain immigration advice from an immigration lawyer or migration advisor to boost your chances of your application being successful.

To be eligible for a Queensland 190 State Sponsored Visa or the 491 Regional State Sponsored Visa, you must meet the Australian Department of Home Affairs and Migration Queensland criteria for your chosen visa category.

With respect to the points score for these respective visas, with Queensland sponsorship, you will receive additional points. For example, an extra 5 points for the Subclass 190 and 15 points for the Subclass 491.

The Department of Home Affairs (DHA) requires you to meet the following criteria:

  • have points test of 65 or higher, inclusive of state nomination points;
  • have a positive skills assessment in your nominated occupation;
  • be under 45 years of age; and
  • meet the minimum English language requirement of Competent unless a higher level is required by your assessing authority.

Before you are able to consider applying to the DOHA for the visa, you will need state nomination. To gain this, Migration Queensland requires you to meet the following criteria:

Visa: Skilled Nominated (Permanent) visa (subclass 190)  Skilled Work Regional (Provisional) visa (subclass 491)
Points: Have points test result of 75 or higher (except for Trades occupations*, which require 70 or higher) Have points test result of 65 or higher
Occupation: Have an occupation on the Queensland Skilled Occupation List (QSOL) eligible for the 190-visa pathway Have an occupation on the Queensland Skilled Occupation List (QSOL) eligible for the 491-visa pathway
English: Have Competent English or higher (except where a higher level of English is required**) Have Competent English or higher (except where a higher level of English is required**)
Work experience:  Must provide evidence of the required years of post-study work experience as per the QSOL.

Commitment to living in Queensland: Must commit to living and working in Queensland for two years (2) from date of arrival Must commit to living and working in regional Queensland for three (3) years from date of arrival

 

The Business Innovation and Investment Program (BIIP)

The BIIP program is distinct from the Subclass 190 and subclass 491 mentioned above however, it is important to note that the DHA has placed a hold on all BIIP nominations across all states and territories of Australia. As a result, Migration Queensland will not be accepting any new Expressions of Interest (EOI) for BIIP during the 2023/24 financial year.

Although no new BIIP applications are being accepted for the 2023/24 program year, Australia is committed to bringing talented individuals to its shores via the Global Talent Visa Program. The Global Talent Visa Program has been allocated a   planning level of 5,000 available spots for the 2023/24 financial year.
